In India there is a talk about heavy backlog of cases pending in all courts beginning from moffusil to Supreme Court of India,estimated at lacs.But recently in Bangalore in a court, a private telecom organisation has filed as many as 73,000 cases on a single day, all cases are pertaining to dishonour of cheques given by the subscribers of a private telephone organisation.When the Chief Justice of the Supreme Court of India, Justice K.G.Balakrishnan came to know about the heavy filing of cases as many as 73,000 on a single day, he said, ‘we are talking about heavy backlog of cases remaining undisposed in our courts. You see on a single day 73,000 cases have been filed in a single court ,in Bangalore, by a private telecom organisation all relating to dishonour of cheques.Of course, on a speedy disposal, a magistrate can dispose of say 15 to 20 cases on a single day.Let us assume , the magistrate dispose of 100 cases on a single day. How to dispose of these 73,000 cases that too speedily.Naturally there is bound to be delay and backlog.What to do ?’
The Chief Justice was right when he said that it is not possible to dispose of all cases speedily by a single judge.When there is a backlog and heavy filing of cases, why don’t he make arrangements to post more judges, at least fill up the sanctioned strength in all the high courts and the mofusil courts.In Chennai, the backlog is mainly due to the paucity of judges. The same is the case with other high courts.Instead of crying over the spilled milk, let him take adequate steps to fill up all posts in the sanctioned category.That will certainly help a lot to dispose the backlog of cases.Let Justice prevail, Let Justice be rendered at all levels !!
