A full court of the Supreme Court on Friday dismissed a review petition filed by a former candidate for the presidential election against the chief election commissioner (CEC) on the basis that the petitioner failed to point out any error in the judgment announced by the court in the case.
The 16-member full court headed by Chief Justice Abdul Hameed Dogar was hearing a review petition of former presidential candidate and a homeopathic Dr Zahoor Mehdi, whose nomination papers had been rejected by the Election Commibssion for lacking proposor and secondor.
Other members of the full court included Justice Muhammad Nawaz Abbasi, Justice Faqir Muhammad Khokhar, Justice M Javed Buttar, Justice Sayed Saeed Ashhad, Justice Ijazul Hassan, Justice Muhammad Qaim Jan Khan, Justice Mohammad Moosa K Legari, Justice Ch Ejaz Yousaf, Justice Muhammad Akhtar Shabbir, Justice Zia Perwez, Justice Mian Hamid Farooq, Justice Syed Sakhi Hussain Bokhari, Justice Syed Zawwar Hussain Jaffery, Justice Sheikh Hakim Ali and Justice Muhammad Farrukh Mahmud.
Dr Zahoor Mehdi, the petitioner, appeared before the full court in-person and sought adjournment of the case; however, the court declined his request and asked him to argue his case. During his arguments, he submitted that he had polled his vote during the general elections of 2002, but his name was not included in new voters list.
After hearing the petitioner, the full court observed that it was mandatory for the aspiring presidential candidate to have his proposor and seconder under the election laws, which the petitioner did not have while filing nomination papers with the Election Commission. Meanwhile, the court dismissed the petition. Earlier, the court had dismissed the petition of Dr Zahoor Mehdi as he had no proposor and secondor while filing his nomination papers which was mandatory under the election laws. Later on Dr Zahoor Mehdi filed a review petition in the apex court.
