The Andhra Pradesh Reorganization (Amendment) Ordnance 2014 meant for transferring of seven mandals of Khammam District of Telengana region into forthcoming residuary state of Andhra Pradesh for the purpose of land acquisition for construction of Polavaram Project, has been promulgated by the President of India on 29/May/2014 making amendment to section 3 of the Andhra Pradesh Reorganization Act 2014, has been stated in section 1 (2) that “it shall come into force at once” – that means that this ordnance will come into force from the day of its promulgation i.e. 29th May 2014.
Now the dispute is that the main Act i.e. Andhra Pradesh Reorganization Act 2014 has not yet come into force. It shall come into force from 2nd day of June 2014 as per the Extraordinary Gazette Notification of Government of India on.4th March 2014, for the purpose of the A.P. Reorganization Act 2014.
Whereas, the Andhra Pradesh Reorganization (Amendment) Ordnance 2014 has come into force at once prior to notified date of main act. Is this legally valid? Any where can the associated amendments/ordnances directly related to the main Act come into force, prior to the date of commencement of main Act? Small precautions could avoid big controversies.
