Jammu, May 1, (Scoop News) -Return of over four hundred thousand aboriginal members of a beleaguered community to the valley is a dilemma confronting the Kashmiri Pandits. Why their return to their ancestral homes is being so vehemently opposed by pro Pakistani fifth column in the valley represented by Tom, Dick and Harry through their outfits? Surprisingly, most of these outfits, over a score to be specific, exist through their press statements only.
How does their return violate the obsolete UN resolutions on Kashmir issue? UN Resolution on the so called vexed Kashmir issue had lost its s. n relevance since, surprisingly, decades ago. Even Kofi Anan, former UN Secretary General, talked several times of shelving the case in cold storage after Shimla and Lahore agreements were signed between two neighboring countries, India and Pakistan, for resolution of all contentious issues between them bilaterally.
Kashmiri Pandits return to their place of birth is their fundamental right and no power on earth can deny it to them provided handled firmly, deftly and with political determination, notwithstanding majority s. n community’s nonchalant attitude. Their return, now or never, can prove a watershed moment in the history and could come about only if the Union Government intervenes directly in their return process. Obviously, it requires major political will on part of Government of India (GoI).
Is GoI willing run its writ in this case? SN reporter spoke to a cross section of displaced Kashmiris scattered in various ghettoes in Jammu, the winter capital of roiled Jammu and Kashmir.
“Surprising”, said Manohar Lal Kaul (72), a retired history teacher, “how does my return to my ancestral home violate the UN resolution? Do they (Pakistan spokesperson) know s. n anything about Pandits? Pakistan was not even born then when Pandits used to live in Kashmir. We have five thousand years old indigenous history and Islam is only 650 years old in Kashmir”.
“If my return means change in demography of Kashmir for Pakistan’s spokesperson, what the hell are these non state subjects doing in Gilgit and Baltistan these days. Under which UN resolution was Gilgit-Baltistan made the fifth province of Pakistan, it was a part of erstwhile Maharajas state as on October 27, 1947 and how could you apply UNSC resolutions to this province ”, he retorted.
“Let them also know who cry day in and day from their rooftop- the UN resolutions on Kashmir has three parts. Part I lays down the conditions and procedure for effecting a ceasefire, Part II deals with procedure s. n of truce agreement, and Part III lays down the procedure for holding a plebiscite. It was a concertina resolution. Unless Part I is accomplished; Part II cannot be undertaken: unless Part II is accomplished, Part III cannot be undertaken”, Kaul said adding that “one cannot jump to Part III straightway while ignoring Part I and Part II”.
He said now implementing UN resolution is all the more impossible because Pakistan had ceded over 5000 sq km to China and again China is occupying over 14,000 sq km of the state’s land since 1962 following Sino- India conflict. The unit of Maharaja’s Kashmir which was presented before the UNSC on January 1, 1948 under chapter VI of the Charter does not exist in the same shape and size as it existed 67 years ago.
Saleema (59), a Kashmiri Muslim widow whose husband was killed by terrorists outside his house in north s.n Kashmir (she requested not to disclose her identity because her parents and in laws continue to live there) has all abuses and invectives for her husband’s killers. She lives with her two daughters and a son in Jammu as a displaced person from Kashmir.
Waving her middle finger she shouts Azadi….. What azadi (freedom)? “We die hundred deaths every day here away from our home, elders and other relatives. What harm my husband had done to them (terrorists)?, Saleema fulminated.
“India has been too soft to them (separatists), don’t they read it in newspaper reports how Pakistan is dealing with its enemies, who challenge the suzerainty and sovereignty of their country. They are using helicopter gunships, artillery, drones and heavy machines guns against them and spared none of their top rebel leaders”, she argued.
“No one talks of our HR violations. They have (terrorists/separatists) given a bad name to Islam also”, Saleema pointed out s.n and said “I feel safe here, my children also feel safe here. Everybody is so helpful and courteous and I feel at home with my neighbours here”.
Sardar Santokh Singh (69), too had migrated from Central Kashmir after his close relative was killed in a militant attack over a decade and half ago near outskirts of Srinagar, the summer capital. Singh squarely blames federal Government for all chaos and confusion in the state.
“All successive governments, both at the centre and state, have been impotent, indecisive and inefficient”, Singh lamented and said “how come you can’t control few hundred terrorists. It was never worse than Punjab in Kashmir even at its peak in early 90’s. If Punjab is prospering today, the credit goes to its people who didn’t cooperate with these anti national elements and allowed peace to return”.
“In Kashmir, terrorism has become an industry and everybody has developed a vested interest in it”, he said adding that “huge inflow of cash from various quarters has blinded the people and they never want peace to return in Kashmir. Conflict brings miseries for the people but in Kashmir it has brought prosperity. See the changed life style of the people does it look like a conflict zone. Freedom struggle is all humbug, just a means to get more and more money from their known quarters nothing else”.
“ Whether we get the freedom or not but we got rid of Kashmiri Pandits,” Singh quoted Kashmiri Muslims saying in private.
Singh said, “things can change overnight in Kashmir provided Central Government takes some tough measures like ending political and administrative corruption, make politicians, bureaucrats and people accountable for their wrong doings. Restore rule of law, even if it means adopting tough action against erring persons, the people will welcome and support it overwhelmingly”.
“We need a strong administrator who could help us to come out of this morass, we are tired now. We have seen lot of bloodshed”, Singh prayed. (Scoop News Exclusive)
