Dr. Nirmal lambasts NC, Congress on gender bias

Jammu, December 05, (Scoop News)- In reaction to State Chief Minister Omar Abdullah and other NC and Congress leaders’s statement that the women who marry non-state subject and their children, in the State of Jammu & Kashmir have all the rights of citizenship and also that BJP’s Prime Ministerial candidate Narendra Modi is not properly informed on the subject, BJP State Spokesperson Dr. Nirmal Kamal lambasted on the issue in a press conference here today. She also gave befitting reply to those who repeatedly say that it is the notification of April 1927 issued during Maharaja Hari Singh that the Permanent Resident Certificate (PRC) is vogue and the State Government has nothing to do with this.
Dr. Nirmal Kamal reacted on the utterances of NC and Congress leaders on three counts.

Firstly, the notification of 20th April, 1927 infact was enacted during Maharaja’s rule (1925-1947) when Jammu & Kashmir was a small kingdom and not the state of India and therefore the Act of 1927 became redundant. It was in 1957 that separate Constitution of the State was promulgated and Constitution of India came into existence in 1950, so the Notification of 1927 which was amended in 1932, became meaningless. When J&K became state of India, there was no need of separate constitution which incorporated provisions of the Notification of 1927 and also made amendments in 1954 and 1956, thereby, twisting the facts which suited the Government without watching the interests of daughters of the soil. On the second count, on 7th October 2002, the majority bench of High Court gave the historic judgement in favour of women that they do not lose the right to citizenship that the problems explicitly came on the surface. As the result of this judgement, on 5th March, 2004, the J&K assembly passed a bill—J&K Permanent Resident (Disqualification) Bill and again on 7th October, 2010, the J&K assembly allowed a PDP legislator to introduce private member bill— J&K Permanent Resident (Disqualification) Bill 2010, which was dropped later. But if passed both the Bills were to terminate citizenship rights of women who marry Non-State Subjects.

Dr. Nirmal Kamal recalled that it was PDP-Congress coalition government in 2004 and NC-Congress coalition government in 2010 when these nasty moves were made and it shows that both the times the Government consisting of PDP, Congress and NC legislators wanted to fiddle with the rights of women and so the intentions of these political outfits were not honest. In this context, how Omar Abdullah says that the women are not discriminated and Modi should update himself. In the end, Dr. Nirmal Kamal suggested that the removal of the separate constitution is the only solution which can remove gender bias attitude from the State.

Dr. Nirmal Kamal, on third count, questioned that if Omar Abdullah and his coterie is correct, then the government should have come out with a notification which unfortunately has not happen. The government’s were also clear when a BJP senior member had filed public interest litigation Hari Om V/s State Government in 2004 and against Hari Om V/s SS Baloria in 2005 with regard to High Court’s order to remove “valid till marriage” inscription from the PRC issued to the women of the state. But the state government never issued a notification regarding the rights of citizenship granted by High Court on 7th October, 2002, instead kept a scope to vitiate the atmosphere further by bringing bills like brought into 2004 and 2010. This confirms that the government had never been sincere to the women of the state.

Dr. Nirmal Kamal cautioned the women in particular and public in general that they should not be trapped into misleading campaign of NC, Congress leaders and also was surprised that PDP has not shown its reaction on the state subject issued while PDP was most vocal when the notorious bills of 2004 and 2010 were introduced in the assembly.
Dr. Nirmal Kamal reiterated that instead of Omar Abdullah should do home work on the issue by consulting history books and consult the record books of assembly proceedings to find out the truth instead of wasting his time on twitting.
