The plaintiff alleges that the defendants took no steps to protect 401(k) plan participants over the last four years while NYSE:RSH shares declined and RadioShack Corporation was on the verge of bankruptcy. The plaintiff claims that the defendants violated the Employee Retirement Income Security Act (“ERISA”), which regulates corporate retirement plans. The plaintiff alleges that the defendants should have known that investing in RadioShack Corporation (NYSE:RSH) stock was too risky and not in plan participants’ best interests. The plaintiff says that it appears that defendants conducted absolutely no investigation, analysis or review with respect to whether it was prudent to continue investment in RadioShack stock in the plans
RadioShack Corporation reported annual total Revenue declined from over $4.03 billion in 2011 to over $3.43 billion in 2013 and that its Net Income of $72.20 million in 2011 decreased to a Net Loss of $400.20 million in 2013. Shares of RadioShack Corporation (NYSE:RSH) declined from $23.65 per share in March 2010 to as low as $0.30 per share on December 19, 2014.
On January 5 2015, NYSE:RSH shares closed at $0.38 per share.
