Jammu, March 17 (Scoop News) -Jammu and Kashmir High Court today in a historical descion while upholding the writ of Abdul Majid Wani additional commissioner,Kashmir in its judgment has said that before the court from last three decades has now satisfaction of having got his grevince redressed due after avoidable long delay . Court in his observation at page no 13 has observed, “ the state government either independent of or persunit to the court order placed number of officers born on different government service mentioned in order no 1285 of GAD in the grade 1560 with effect the date of 20th August ,1983 in respective of amendment in the recruitment rules.”
Mohd Ashraf Buhkari one of such officers is said service still struggling of their placement in the grade of Rs 156o with effect the date of government order no 1285 GAD of 1983. Thus there is no reason for the Govt to deny the benefit to Abdul Majid Wani.
Accordingly the High Court quashed today the seniority list of KAS officers of dated 1999 and 2001.
It is worth to mention of several high level officers have been inducted in IAS on the basis of said seniority.
Now the KAS seniority remained quashed and High court has given eight weeks time to the govt for restoring the seniority of the petition on basis of its own already issued govt order including 1285 of 1983.
This High court order will help the Additional Commissioner Abdul Majid Wani to get retrospective inductions at several levels.
