In a strange cheating case, a husband got a decree of divorce against her legally married wife, by presenting a dummy wife in Lok Adalat (Family Court). After getting the decree of divorce, the husband ‘Sanjib’ ejected her legal wife, ‘Dipika’ from his house who then moved to her parent’s house in Calcutta with her six-year-old son.
Perplexed about the Divorce, Dipika enquired about the case and found to her surprise that her husband has moved a joint petition under section 13B of Hindu Marriage Act 1955- for dissolution of marriage by mutual consent- presenting a dummy wife in a Family Court in Calcutta, which issued a decree of divorce on 20th January’08.
Calcutta High Court (HC), on 16th July stayed the divorce decree and asked the Family Court to send all documents relating to the decree, after Sanjib Saha’s real wife Dipika moved a petition to cancel the decree.
The decree, in all likelihood would be cancelled at the next hearing at the HC and the ‘clever husband’ is in for charges of misleading the court with false evidence and may land in jail for three years.
