Jammu, Dec. 28: In order to highlight the demand of restoration of reservation in promotion for reserved categories employees in J&K State, the Jammu Kashmir Reserve Categories Employees Association (JKRCEA), a frontier association of employees Scheduled Castes (SC), Scheduled Tribes (ST), Other Backward classes (OBC), Residents of Backward Areas (RBA) and Actual Line of Control (ALC) categories have organised a series of conventions on “Save Reservation in Promotion” at Hiranagar, Billawar and Doda.
At Hiranagar, Hon’ble MLA Mr. Kuldeep Raj was the chief guest whereas at Billawar, Hon’ble MLA Bani, Mr. Jeewan Lal was chief guest of the programme organised the local unit of JKRCEA.
Mr. Kuldeep Raj while speaking on the occasion said that he would do his best to protect the constitutional rights of the reserved classes whileas MLA Bani told the gathering that in case the reservation in promotion will not be restored by the coalition govt., he would tender his resignation.
The Save reservation convention at Doda was organised by Chenab Valley Unit of JKRCEA. Dr. Sanjay Bhasin, State President of JKRCEA was Chief Guest of this programme. While addressing the convention, Dr. Sanjay Bhasin, Chief of JKRCEA said that the SCs/STs/OBCs/RBAs and ALCs which constitute more than 60% population of the state are not adequately represented thus should be given justice. He further said that these reserved communities expect that the present govt. will not overlook this serious issue of reservation in promotion but till date the govt. seems unsatisfactory. Bhasin also lamented that these communities came to know that Govt. miserably failed in protecting its own Act and has not provided the data required by Hon’ble DB during the proceeding of the instant case. The present govt. is appealed to either bring an appropriate ordinance or challenge the verdict in the Apex Court.
At the sideline of this convention, Dr. Zabeer Ahmed, General Secretary JKRCEA while speaking to the media persons said that with the formation of new coalition government, the reserved classes expected due benefit of the reservation but if the current ruling on reservation is implemented, the government would deprive the reserved communities of their rights. “If the government will not take this grave issue very seriously or will not take any remedial step to restore the reservation in promotion for the reserved classes, these communities would be forced but to come on roads and protest against this biased move of the government.” he added.
Ahmed also said that these categories have been united over this issue and put further pressure to resolve the issue.
Pertinently, the J&K High Court, in its judgment on October 9, 2015, struck down some sections of the Jammu and Kashmir Reservation Act. The court struck down Section 6 of the Jammu and Kashmir Reservation Act, 2004, and Rules 9, 10 and 34 of the Jammu and Kashmir Reservation Rules 2005. The reserved categories challenged this verdict in the Apex Court and got the status quo over the DB judgement.
Joginder Singh Rai, Chairman, Chenab Valley Unit of JKRCEA said that the govt. data itself indicates that negligible percentage of reservation has been practically given to these categories in appointments and promotions itself thus the reservation in promotion is required to be protected at any cost.
