Pak Assembly resolution mischievous: Dr Jitendra

Jammu, February 06, (Scoop News)-Denouncing the Pakistan National Assembly resolution expressing “moral, political and diplomatic support” to the people of Jammu and Kashmir in their so-called struggle,BJP National Executive Member & J&K Chief Spokesperson Dr Jitendra Singh said here today, the question is not what Islamabad is doing but the question is what New Delhi is doing to hold back Pakistan from indulging in this mischief from time to time and why the Congress led UPA government is silent over the resolution.

Dr Jitendra Singh alleged, the Pakistan resolution is not only a violation of the accepted norms of international diplomacy but also a blatant interference in the internal affairs of India. It is surprising why the Govt of India’s Ministry of External Affairs has failed to take a position on the issue,he said.

Commenting on the Pakistan resolution’s reference to plebiscite followed by Geelani’s statement urging Islamabad to carry the issue to United Nations,Dr Jitendra Singh reminded that the 13 August,1948 UN resolution on “plebiscite” had laid down two pre-requisites a) cease-fire and b) truce. When Pakistan failed to fulfill these pre-requisites, the UN Security Council in December 1948 had stated that if Pakistan was not abiding by these conditions, the resolution was no longer a binding on India,he added.

Citing historical evidence, Dr Jitendra Singh said,Jammu & Kashmir acceded to India under the provisions of same Instrument of Accession and same legalities which were applicable to other princely states of the subcontinent. Thereafter, the acceptance of the constitution of India by the then Regent of J&K in November 1949 followed by endorsement of the same by the Constituent Assembly of J&K in February 1954 signified culmination of a due process of determining the will of the people,he added.

Contesting the resolution’s expression of official support to a separatist movement,Dr Jitendra Singh cited International Law to state that India is a federation and, according to International Law, “secession’ is not an option available in any federation.

Dr Jitendra Singh said, as far as India is concerned, the only pending agenda over Jammu & Kashmir, as also endorsed by the 1994 unanimous resolution of the Indian Parliament, is to retrieve back the area of the State which continues to be under illegal occupation of Pakistan.

Dr Jitendra Singh called upon the Govt of India to tell Pakistan in clear terms to immediately stop exporting terrorism and sponsoring militancy on the Indian soil.
