The Supreme Court in a determination to cause to resolve the witnesses petition from testifying in the senate hearing regarding the ZTE-NBN deal controversy have dealt a blow to the ongoing senate investigation which calls for the truth to come out. Although the Supreme Court mandated all government officials to attend the senate hearing, the Chief Justice prevented the senators from asking resource persons of questions that directly point to the president.
By in large, the Supreme Court unanimously and deliberately ordered a favorable decision to block the truth so as to protect president Arroyo from corruption charges which the senators suspected that the president herself is involved. According to the senators, the SC decision ultimately clipped their power to investigate anomalies in government.
Constitutionalist Fr. Joaquin Bernas questioned the SC decision for issuing certain parameters on how the senate should conduct investigation on the ZTE-NBN scandal. He further noted that the primary concern of all is for the whole truth to come out. The SC should’ve prevented itself from issuing legal impediments that would make the senate powerless in their constitutional duty to investigate massive corruption in government.
