Recently the Supreme Court of India upheld the 27 % reservation for OBCs, in the higher educational institutions excluding the creamy layer with a reasoned argument and judgment. The Government of India also duly obeying the order of the Supreme Court of India, has proceeded to implement the 27 % quota for OBCs. The IITs, The IIMs, AIIMS etc are implementing the Quota system in a phased manner, since the Court has given a breathing time to implement the quota of 27 % within 2010.
The Supreme Court has reconciled to the 27 % quota for OBCs, since they belong to SEBC (Socially Economically Backward Castes).However, still some political leaders in Tamil Nadu, the Octogenerian leader and the Chief Minister of Tamil Nadu,Mr.Karunanithi and the PMK leader Mr.Ramadass, are still clamouring for the implementation of 27 % for OBCs without excluding the creamy layer.
While the Supreme Court has been prompted to exclude the creamy layer among the OBCs on the basis of present social set up, facts and figures and above all taking the reality into account and by applying the well known judicial principles of justice, equity and good conscience, the political leaders mentioned above are clamouring to do away with it, mainly for their political gains, to retain the vote bank and above all keeping an eye on the forthcoming elections to the Loksabha. The PMK leader has not only been vociferous to do away with the creamy layer,but also he has gone a step further, that an amendment should be brought up to strike down the creamy layer aspect,and the legislation should be kept under the IX schedule of the constitution of India beyond the purview of the Judicial Review. While the Supreme Court has categorically stated that the Quota System should be reviewed after five years, the PMK leader wants to make it as a permanent peace of legislation beyond the purview of Judicial Review.
Such tendencies of the political leaders should not only be discouraged and people should be able to identify their real motive.
Reservation, whether it is meant for SCs or STs or OBCs, is only to remove their social, educational and economical backwardness, but not to keep them permanently at the present stage of their backwardness.
