New Delhi/Jammu, August 13 (Scoop News)- The order of the a Division Bench of the Supreme Court of India headed by Chief Justice P. Sathasivam comprising Mrs. Justice Ranjana Desai and Justice Ranjan Gogoi directing the Chief Secretary of J&K to file a detailed affidavit on the Crl. M.P. filed by J&K National Panthers Party on the Kishtwar situation was hailed by different sections of the society throughout J&K.
The petition was argued by Prof. Bhim Singh, Sr. Advocate seeking urgent
intervention of the Supreme Court of India for the safe and secured passage of the stranded Machel Mata pilgrims between Kishtwar and Gulabgarh (Padar) since 9th August, 2013. The Panthers Party petition has also sought facilities like food, lodging and medical care for all the stranded pilgrims which include children, women and elder people. They are still 257 stranded pilgrims according to the Govt. of J&K.
Prof. Bhim Singh, Sr. Advocate also sought judicial inquiry into the horrifying tragic incident that shook the entire humanity on Eid Day, the 9th August, 2013 when three innocent people were killed and shops, houses, vehicles of the local residents were destroyed by the agitating mob in the presence of the administration and the police.
Supreme Court directed the Chief Secretary of J&K to file affidavit on the prayer made by the JKNPP demanding adequate compensation for the loss of precious lives and the property in Kishtwar.
The Supreme Court rejected the prayer of J&K government that affidavit may be filed by the Home Secretary while accepting the plea of Prof. Bhim Singh. The Court made clear direction to the Chief Secretary of J&K rejecting the J&K government’s prayer.
Prof. Bhim Singh vehemently argued that the people of Kishtwar have been fountain of secularism and what happened on 9th August was due to the criminal negligence of the government of J&K. He emphasized that a sitting judge of the High Court should hold judicial inquiry into the entire circumstances that led to riots, killing and imposition of curfew in Kishtwar. He submitted that the Chief Justice of J&K may be requested to appoint a sitting judge of the High Court so that the real culprits should be brought to justice. He emphasized that communal harmony is needed most at this time.
Prof. Bhim Singh also informed the Supreme Court that the government has blocked all local video channels, electronic communication which has given the rumour mongers freedom to spread false news and propaganda to incite conflict and communal passion. He prayed for the intervention of the Supreme Court in this regard also.
The Supreme Court shall hear the matter on Wednesday, the 21st August, 2013. The Union of India has also been issued notice.
