The world is clamoring for the abolition of death sentence and recently the UN has even passed a vote against the death sentence and also has called upon the world countries to enforce a moratorium for a period of six months in awarding the death penalty to the culprits. The idea or logic behind such move was, awarding death sentence is barbaric and based on tooth for tooth, eye for an eye concept, which has long back become obsolete.
Sometimes, even the courts are forced to invoke the death punishment, considering the gravity of the situation. When a crime is committed repeatedly and cruelly, there is no scope for clemency and the courts have no other go but to award a death sentence in favor of the culprit. Then only people will have some faith over the law and the courts which enforce them.

The culprit has been a habitual offender and this is not the first instance of rape of minor victims committed by the culprit..He had already had got two years imprisonment for raping a minor girl and was again convicted for 9 years for raping yet another minor girl in the same year. And after undergoing those punishments, the culprit has committed the offense for the third time.
The Supreme Court of India while confirming the death sentence has held that if clemency is shown towards such habitual and cruel offenders, the people will lose their faith on law and law as an instrument of justice will lose its credibility. Therefore, this court has no other go but to confirm the punishment of death sentence awarded by the lower courts to the culprit.
