WILL RAJAPAKSE’S 13 AMENDMENT MANTRA REDEEM DELHI’S SAVAGED IMAGE? Rajapakse’s recent recital of the 13 Amendment mantra to redress the Eelam Tamils’ trauma deservedly passed off as a non-event. Rajapakse and SL customarily play games over this issue; now it is the 13 Amendment. SL’s end game is to extricate itself from the international war crimes without compromising an iota on achieving its genocide objectives. The SL genocide is to defeat alleged attempts at separation by the Eelam Tamils whether as the inconsequential 13 Amendment devolution or federalism. Rajapakse’s timing is significant. On this occasion a badly mutilated version of the 13 Amendment is flaunted before a Delhi desperate to avoid a major electoral backlash in TN against the DMK and its Sonia/UPA partner in Delhi. The TN electorate is seething with anger over Delhi/Chennai deceptively supporting SL and committing massive atrocities notably the Mullivaykkal massacres and Menik camp mass internments from 2004 to 2009. Brahma Chellaney relates Delhi’s policies to the ‘personal caprice’ of those in effective power. It is ‘personal caprice’ that forced Sonia to deliver the head of Prabhaharan to Rajapakse an undelivered commitment under the 1987 JR/Rajiv deal. Rajiv in 1987 could not, when General Harikirat disobeyed Rajiv’s ‘kill Prabhaharan’ order. Sonia deftly used her proxies Narayanan/Menon and Gothabhaya Rajapakse for this purpose. Symbolically sacrificing Prabhaharan’s head constituted the most humiliating setback for the Tamil cause and the Tamils. Delhi/Colombo now offers a ‘mutilated’ version of the 1987, 13 Amendment to the defeated Tamil Eelam nation; a further act of humiliation. The Narayanan/Menon duo brainwashed Delhi and Colombo that Tamil politicians anywhere are ‘fools and clowns’ who are easily coerced into accepting anything now that Prabhaharan/LTTE are no more, and the Tamils as a defeated people have no alternative but to accept what the victors Delhi/Colombo offer them. The key players on the Eelam Tamil side; the popularly elected representatives of the Tamils then (the TNA) and the Tamil militancy (the LTTE) opposed the 13 Amendment as pathetically inadequate to protect the lives and identity of the Eelam Tamils fighting SL genocide. Survival had become the essence of the Tamil cause. The provisions enshrined in the 1957 Bandaranayake-Chelvanayanagam and other Pacts signed by the popularly elected Sinhala and Tamil leaders were better. Once the Buddhist Sinhalese leadership reneged on the Pact(s) the popularly elected moderates (TNA) adopted the Vaddukkottai resolution in 1976 accepting armed struggle as a component to survive the brutal Buddhist/Sinhala genocide. The Buddhist Sinhala genocide assumed barbaric levels to erase clean the face of SL of Tamils. Details of the tragic and brutal abuses inflicted on the Tamils more so since 2004 with Delhi’s active support are adequately documented by independent sources to sustain the world community’s initiatives seeking accountability for crimes committed before international tribunals. The quid pro quo that Sonia/Delhi unlike Indraji pleads for not demands from Rajapakse is the implementation of the 13 Amendment as it was. This is to stave off an electoral backlash for Delhi’s role in the Mullivaykkal massacres and Menik farm internments. Indraji’s response to the SL genocide right from the beginning was to openly and honestly support measures to redress the sufferings of the Eelam Tamils. Indraji undoubtedly a strong leader of high intellect that despite risks delivered freedom for the Bengalese people suffering oppression comparable to that of the Eelam Tamils. The British left the present Bangladesh as part of Pakistan (a single entity) as it left the Tamil Eelam as part of independent Ceylon. Indraji reacted promptly and decisively to end the brutish Punjabi Pakistan oppression of the Bengali people creating Bangladesh. In Indraji’s dharmic mindset ‘humanitarian and justice’ considerations were uppermost that splitting the Pakistan entity was inconsequential. Indraji who delivered justice to the Bengalese acted firmly and this saved lives and prevented human sufferings; an achievement that occupies a pre-eminent place in the annals of Indian history. In contrast the Rajiv/Sonia approach sought to reverse/undo the noble contribution of Indraji’s to the Tamil cause. According to Brahma Chellaney ‘personal caprice’ (and private gain) replaced the dharmic flames of ‘humanity and justice’ found in Indraji’s policies. According to Anil Athale Rajiv (a dismal failure as Prime Minister) who profit(ed) from the Gandhi name to become the Prime Minister sidelined Indraji’s ‘humanity and justice’ considerations opting instead for suspect deals. That Rajiv/Sonia era was/is ridden with questionable deals/scandals is public knowledge. Rajiv’s 1987 JR/Rajiv’s IPKF deal falls into the Rajiv’s Bofors class; the result of a one-to-one, JR/Rajiv tete-a tete. That led to an Indo-SL Accord, the introduction of the IPKF in a mercenary role and the 13 Amendment. Paying lip service to the Tamil cause the JR/Rajiv deal disguised Rajiv’s commitment to crush the Tamil militancy fighting SL genocide whose growing strength was slowing down the SL genocide and saving the lives of the Eelam Tamils. This was anathema to the ‘bungling’ sectarian South Block bureaucrats and RAW. RAW was concerned that LTTE was unlikely to toe the Delhi line and disarm, a Rajiv’s contractual commitment to SL’s JR. Anil Athale, points to Rajiv’s naiveté for becoming a victim of the ‘bungling’ South Block and RAW’ who identified for Rajiv, Prabhaharan and LTTE as obstacles to Rajiv delivering on the JR/Rajiv deal. To control the LTTE, Rajiv first replaced the Madras regiment in the early IPKF years when JR telephoned demanding that Rajiv replace the Madras Regiment for being too cozy with the Tamil population with a tougher lot. Rajiv naturally obliged promptly as required under JR/Rajiv contract. Open hostilities between the IPKF and the Tamil militants followed when the ‘tougher’ IPKF elements committed serious human rights abuses including civilian massacres, disappearances and rapes. A rape victim blew up Rajiv in 1992.The Valvettiturai and Jaffna teaching hospital massacres were precursors to the Mullivaykkal massacre ordered by the Gothabhaya/Narayanan duo that have UN war crimes implications. RAW’s advice to Rajiv was also that Prabhaharan had to be eliminated. Hence Rajiv’s ‘kill Prabhaharan’ order to General Harikirat (Head of the IPKF).The upright General disobeyed the order; Prabhaharan was an invitee to a meeting with the General and killing him then breached military codes to border on a war crime. Rajiv’s naked ‘kill order’ was unambiguous compared to the UN Nambiar encouraging surrendering Tamil fighters to come out with white flags to be shot and killed in May 2009. (Inner City Press January 19) Nambiar’s conduct is under scrutiny for war crimes implications. Gothabhaya. ordered that all surrendering militants be finished off only after the ‘in the loop’ consultations with Narayanan. This order is also being scrutinized for war crimes implications. Effectively Rajiv sought and failed to implement the 13 Amendment over the ‘dead body’ of Prabhaharan. But Sonia delivered to the Rajapakses Prabhaharan’s Mullivaykkal mutilated head, a Rajiv’s commitment outstanding under the JR/Rajiv 1987 contract. Now Sonia is struggling to get Rajapakse to implement SL’s commitment on the feeble 13 Amendment devolution to Rajiv under the same JR/Rajiv contract more than two decades late. It’s a pity that Rajapakse believes that Sonia/TN CM/Indians (Narayanan’s ‘jokers and clowns’) can be placated with a strangulated version of the 13 Amendment, The IPKF debacle combined with Rajiv’s deals/scams amongst others caused the massive defeat for Congress in 1989 losing more than 50 per cent of the seats that Congress won on the sympathy votes following Indraji’s assassination. A disheartened post Rajiv (1989 -2004) Delhi withdrew the IPKF and observed truthfully and scrupulously a policy of non –interference in SL affairs. Those 15 years of non-Congress rule in Delhi allowed Eelam militants to resist SL genocide effectively, set up a de facto state that protected the Tamils from Sinhala oppression throughout SL (unlike the meekly life the Tamils lead in the South today). Unlike the indifference of the Sonia/UPA/DMK rule when the TN Tamil fishermen are subject to daily harassment by the Sinhala navy, the Eelam Tamil militants provided foolproof protection by ensuring that the SL armed forces including the SL navy to remained within their bases at all times. Delhi’s role in the Mullivaykkal massacres, Menik camp internment of over 300 000 civilians, arm twisting Chennai into toeing the Delhi anti-Eelam line, indifference over attacks on TN fishermen by the SL navy and the excesses of the scam culture (2G scam) are bound to deliver a 1989 level of defeat for Sonia and the UPA at the next polls. Popular Congress vote down to 28 percent in 2008 is too narrow to save Congress from the political exile that awaits it. Rajiv offered one head (Prabhaharan’s) to achieve Delhi/Colombo objective; eliminating the Eelam Tamil resistance and offering the 13 Amendment as a sop. Sonia played for bigger stakes acceding to sacrifice the heads of over forty thousand civilians and the white flag waving surrendees of the Tamil militancy. Sonia delivered Prabhaharan’s head as contracted under the JR/Rajiv deal but Rajapakse has yet to deliver on the unhelpful 13 Amendment devolution as originally contracted To forestall a repeat of the 1989 polls disaster Congress and UPA are resorting to desperate measures including soliciting the support of the world renowned genocide war crimes fugitive the Rajapakse. Rahul/Sonia expect Rajapakse implementing the 13 Amendment to placate the anger amongst Tamilians despite the 2009 Mullivaykkal massacres and Delhi supported humiliating defeat of the Eelam Tamils. Being an emotional issue for all Tamilians the 2008 demonstrations involving all Tamil parties gathered momentum to totally shutdown TN and for the Delhi silenced TN CM to speak out on the Eelam Tamil issue. But Sonia had on hand proxies Pranab, Chidambaram, Narayanan amongst others to hasten to Chennai, use the 2G issue to browbeat the TN CM to fall in line with Delhi and support the Rajapakse genocide. The UPA using the 2G scam weapon here implies UPA’s involvement in the scam, a conduct electorally damaging. Rahul the new born only wise person in the Congress keen on rejuvenating the Congress is pushing to go it alone discarding its UPA coalition partners especially the DMK. DMK’s own acts inflicted much damage to its political fortunes. Rahul has yet to digest the bitter Bihar message for his grandiose plans to marginalize the DMK and discredit the wider Dravida movement with its strong grass root groups spread across TN, to succeed. Rahul assisted by Sonia proxies Pranap/Chidambaram undercut the DMK by demolishing its long established credentials as champions of the Tamils blackmailing DMK with the 2G scam into toeing Delhi’s anti Eelam Tamil line, observing a shameful stilled silence over the Mullivaykkal massacres and Menik farm internments; a disaster for DMK electorally. Daily Mirror’s ( 28 Jan 2011) hint of a TN CM’s Rajiv type deal with Rajapakse/Kanimoghzi explains his silence/support for SL genocide. TN CM more concerned about his political survival and sharing the 2G loot put the lid on all pro-Eelam protests jettisoning Periyar/Anna’s Dravida aspirations and values. The surface calm managed by TN CM’s powerful media acolytes hides the deep resentment below over the betrayal of Tamil/Dravida aspirations. The unforgivable affront for TN Tamilians’ self respect is being manipulated away from expressing their legitimate anger over the 40 000 Eelam Tamilians massacred along with the non combatant leadership offering to surrender. SL genocide especially ethnic cleansing is proceeding faster post LTTE that all traces of the Tamil homeland in SL will be erased requiring a re-write of Tamil history; this will also expose DMK’s cowardly betrayal. Delhi administers one humiliation after another on Chennai that it has to remind an unconvinced Delhi that TN Tamil fishermen are Indian citizens and deserved to be protected by Delhi from attacks (these are numerous) by the Sinhala navy. When the Oxford Union denied Rajapakse a war crimes fugitive a platform, Delhi/PM Singh conferred on him an honoured guest status at the Commonwealth Games closing ceremony in a rebuke to TN CM and the DMK leadership. The message is that the DMK is now an expendable entity and reminding the DMK to behave to remain in the UPA. Though poor poll prospects drive both the Congress and the DMK to cry hoarse that their ties are strong such hysterical cries fail to hide the deep strains within UPA close to elections in TN. The signals for the UPA and DMK are ominous. Analysts predict that the electoral verdict in TN will be a repeat of the Bihar verdict for the DMK/Congress combine, ending the scam afflicted UPA regime and freeing Eelam Tamils from the Colombo/Delhi genocide tyranny.
